1. Prices
1.1. The prices showed in the online shop are indicated in Swiss francs, net amounts, all taxes included. Please note that all products sold by Samuel Bitton Photography via the online shop are not subject to VAT (Value Added Tax), whether they are destined for the Swiss market or any other foreign mark.
1.2. For all purchases where the delivery address is located in a country other than Switzerland, the shipping costs mentioned only include the cost of packaging and the cost of the carrier's service. They do not include any eventual taxes and customs clearance fees that the country for which the goods are destined may charge. The buyer is requested to check with the customs authorities of the destination country to evaluate these costs.
1.3. Items benefiting from a guarantee are subject to the conditions of the offer valid at the time of purchase. The guarantee takes effect on the date of delivery of the article, justified by the accompanying document (invoice) which we ask you to keep carefully. The following are not covered: damage due to poor maintenance, non-observance of the instructions for use, or normal wear and tear.
2. Availability
2.1. Our obligation to deliver shall be void in the event of failure or non-compliance with delivery dates on the part of our own suppliers and insofar as we are not responsible for such unavailability. In the event of unavailability of a product, we will inform you as soon as possible.
3. Terms of payment
3.1 Methods of payment:

- Bank transfer
4. Delivery and transport
4.1. Available items are sent by regular mail.
4.2. For items other than art prints, the time limit for national shipment (within Switzerland) is approximately two working days.
4.3. For items other than art prints, the time for international shipping is about 5 to 10 working days. In some cases, this period may be longer depending on the customs requirements of your country.
4.4. For fine art prints, the delivery time is 4 to 8 weeks depending on the type of framing chosen.
4.5. Case of an original fine art purchase (framed or unframed):
4.5.1 Delivery: Upon receipt of the package, we strongly advise you to check its external condition. In case of any doubt, open the package in the presence of the carrier. He has the obligation to wait. Once the package is opened, check the condition of the artwork. In particular, check by passing your finger delicately along the edges and corners of the frame or print after having removed the foam corners if necessary. In case of any damage, indicate on the damage declaration slip the exact name of each damaged product as shown on the invoice attached to the order in the email you received. If you have chosen to have your order delivered to a third party, it is up to them to carry out these checks.
4.5.2. Insurance: If the package is accepted without verification or if the damage declaration slip does not contain the exact list of damaged items as shown on the invoice, the carrier's insurance will refuse any compensation. In any case, contact us as soon as possible.
4.5.3. Unpacking: When unpacking, take care to remove the tape that held the soft protective paper and other packing materials. When removing the soft protective paper, make sure that it does not damage the printed surface or the edges of the artwork.
4.5.4. Hanging and care: Please read carefully the document entitled "Important Recommendations" provided with each artwork, where you will find additional information about hanging and care of your artwork.
5. Return or exchange of goods
5.1. Items must be returned intact and complete in their original packaging (with labels bearing their references), accompanied by the delivery slip, within 7 days of receipt of your package.
5.2. The shipping costs related to the return are at your expense.
5.3. In the case of an exchange order, the shipping costs of your new order are at your expense.
6. Legal guarantee
6.1. Check the condition of the delivered goods immediately upon delivery to exclude obvious material and manufacturing defects as well as transport damage.
6.2. In accordance with the law, you are obliged to notify us of any defects or faults in the delivered goods so that we can rectify them.
7. Data processing
7.1. All personal data will be treated as confidential.
7.2. The information necessary for the management of the order will be subject to computer processing and may be communicated to associated companies but only as part of the management of the order.
Confidentiality policy
Your privacy is very important to us. We will only use your personal information to manage your orders and workshop reservation(s) and to provide you with the products and services you requested or ordered from us. For your convenience, we have detailed below how your data is collected and used by us, as well as the third party data processors we use in our workflow.
When you purchase products and/or services from us, your details are used to manage the shipment of the products or, in the case of the services we provide (e.g. photo courses), to manage your booking(s).
The following data processors / data controllers are used in our transactions with our customers depending on the products and services purchased.
1. Website (WordPress)
Our website is built on a WordPress platform. It records all the information that you are asked to provide in the context of your purchases or newsletter subscriptions. But it does not store your credit card details. Your credit card details are never known to WordPress or us and are encrypted and transmitted to PayPal which is the payment processor we use. Your order details are kept indefinitely on our WordPress platform for administrative purposes only.

2. Payment Gateway (PayPal)
PayPal is the online payment processor for processing credit and debit card payments. Your credit card details are known only to PayPal and are transmitted in encrypted and secure ways. Your credit card details are never shared with or known to us. Your bank details remain completely private between you and PayPal.

3. Billing and customer contact information
All the contact details you provide when ordering on our website are stored on the WordPress server (see paragraph above) and duplicated on our local computer platform in various files for administrative purposes when creating invoices, organizing mailings, organizing photo workshops, as well as registering limited editions of our art prints. All necessary measures are taken to ensure that they are neither stolen nor read by third parties.
In the case of mailings, we send a copy of the invoice to our service providers BVA Marketing and TiragePro so that they can proceed with packaging and shipping our products to you.

Under no circumstances will we pass on your details to other third parties without your prior consent. Our files containing customer details are stored on our local computer system, and saved in an encrypted Dropbox folder to which only we have access.

4. Interaction by email (Infomaniak)

If you would like us to remove your e-mails from the database, please contact us and we will delete them.
5. Newsletter (Mailchimp)
All our newsletters are sent via the Mailchimp service.
Your e-mail, name and surname are automatically added to the distribution list of our Newsletter only if you tick the box provided for this purpose ("I wish to subscribe to the Newsletter") in the order form when you purchase in our online shop.
If you click on the "I register" button on the Newsetter page of our website, the first name, last name and e-mail address you enter in the registration form will automatically add this information automatically to our newsletter distribution list. This information is saved on the Mailchimp website.
